Ioannes DANTISCUS to UNKNOWN [Ermland (Warmia) Canon]
Heilsberg (Lidzbark), 1545-10-28

English register:

The woman [Barbara Kempsche] who will deliver this letter to the addressee is appealing to Dantiscus once again. She has stated to him that she has pursued her claim on several occasions before the addressee and his predecessor, and that the verdict has already been referred for enforcement. Nothing remains in dispute, save for certain monies which, as she contends, the city council of Elbing (Elbląg) has seized without cause. Dantiscus would not, however, wish this matter to be brought before him, just as he would not want his independent jurisdiction in spiritual matters to be encroached upon by the said council. He therefore instructs the addressee to summon the opposing party (the woman’s husband, who has already been called before the bishop once before) and to call on him again to appear under threat of excommunication. The addressee is to examine the matter thoroughly and inform Dantiscus of any impediments that need to be removed. Should the husband fail to appear, the addressee is to exercise the powers available to him.

Venerabilis Domine, frater sincere nobis dilecte.

Iam secundo ab hac muliere, quae has nostras litteras Fraternitati Vestrae reddet, interpellamur. Exp[o]suit autem nobis, quod causam coram Fraternitate Vestra et eiusdem praedecessore saepius agitatam habeat. Quae etiam iam exsecutioni demandata s[it], ita ut nulla lis reliqua sit, quam ob quosdam census, qu[i] illi a magistratu Elbingensi, ut illa refert, arrestati sine aliqu[a] causa detinentur. Nollemus tamen, si certo nobis constaret, h[anc] causam ad forum nostrum pertinere, iudicia nostra spiritualia, quae nobis libera esse, nolumus a di[cto] magistratu interturbari. Quare iniungimus Fraternitati Vestrae praesentibus, quo partem adversam, maritum eius, semel iam a vobis ad praesentiam nostram vocatum, denuo sub excommunicationis poe[na], ut se sistat, citet et diligenter ea causa examinata nobis sign[i]ficet , quinam scrupulus in ea haereat et eximendu[s] restet. Si non comparuerit, Fraternitas Vestra officio suo utatur , factura Fraternitas Vestra, quam feliciter valere cupimus, pro officio su[o].
